Welcome to Kingston Pickleball Centre (KPC). We want everyone who enters our Venue to enjoy a safe, welcoming and inclusive environment.

These Terms of Entry are a summary of our full Terms & Conditions. By making a booking, purchasing a product or service, entering or remaining at the Venue, participating in an activity, or allowing a child or minor in your care to attend or participate, you agree to comply with these Terms of Entry and our full Terms & Conditions.

Play Safely

• Pickleball and other activities at KPC involve physical exertion and risks, including slips, trips, falls, collisions and injuries caused by balls, paddles, equipment or other participants.

• Only participate if you are physically and medically fit and able to do so safely.

• Participate within your own ability, fitness and experience.

• Do not participate if injury, illness, fatigue, medication, alcohol, drugs or another condition makes participation unsafe.

• Follow all venue rules, safety signage and reasonable instructions given by KPC staff, coaches or representatives.

• Stop participating immediately and notify a staff member if you feel unwell, injured, dizzy, unsafe or experience unusual pain or discomfort.

• Report hazards, damaged equipment, unsafe behaviour, accidents, injuries and near misses to KPC staff as soon as possible.

KPC staff and coaches are not medical practitioners and cannot assess or provide medical clearance regarding your fitness to participate. If you are unsure whether you should participate, seek advice from an appropriately qualified health professional.

Protective Eyewear

Pickleball carries a risk of eye injury from balls, paddles and other equipment.

KPC strongly recommends that participants wear safety glasses or appropriate protective eyewear while playing. If you choose not to wear protective eyewear, you accept the increased risk of eye injury.

Children & Minors

• A parent, guardian or authorised adult accepting these Terms for a child or minor is responsible for ensuring they comply with KPC’s Terms, venue rules and safety requirements.

• Children under 10 must be supervised by a parent, guardian or responsible adult at drop-off, pick-up and while inside the Venue unless KPC has agreed otherwise.

• Parents and guardians are responsible for deciding whether a child is physically and medically fit to participate.

• Additional consent, emergency contact, medical or collection information may be required for children’s programs.

Respect Others

Everyone at KPC must treat participants, staff, coaches, visitors and other users of the Venue with respect.

Abusive, offensive, threatening, discriminatory, intimidating, harassing, disruptive or unsafe behaviour will not be tolerated.

KPC may refuse entry, suspend participation, cancel a booking or require a person to leave where reasonably necessary for safety, behavioural, operational, legal, insurance or venue management reasons.

Venue Rules

While at KPC:

• Non-marking sports shoes must be worn on court.

• High heels or footwear that may damage the courts or flooring must not be worn in court areas.

• Do not bring food or liquids onto the courts unless permitted by KPC.

• No smoking, vaping, alcohol, drugs or illicit substances are permitted.

• Weapons, glass and other dangerous or prohibited items are not permitted.

• Animals are not permitted, except assistance animals as required by law.

• Do not enter staff-only or restricted areas unless authorised.

• Equipment and facilities must be used safely and only for their intended purpose.

• Damaged, faulty or unsafe equipment must not be used and should be reported to staff immediately.

Personal Belongings & Lost Property

You are responsible for your personal belongings while at the Venue.

To the maximum extent permitted by law, KPC is not responsible for personal belongings that are lost, stolen or damaged.

Lost property may only be retained for a limited period and may be donated or disposed of if it remains unclaimed.

Photography, Filming, CCTV & Privacy

CCTV may operate at the Venue for safety, security, incident management, insurance, operational and legal purposes.

KPC may take photographs, video or audio recordings during activities, programs and events for operational, educational and promotional purposes in accordance with our Privacy Policy.

We will not knowingly use identifiable photographs, video or audio recordings of a person under 18 for promotional or marketing purposes without parent or legal guardian consent.

If you do not wish to appear in promotional photographs or recordings, please notify KPC in writing.

Participants and visitors must not photograph, film, livestream or record at the Venue without prior KPC consent.

You must not photograph or record a child or minor without KPC’s consent and the consent of the child’s parent or guardian.

Bookings, Cancellations & Attendance

All bookings are subject to KPC’s full Terms & Conditions and any specific booking terms applying to the relevant session, program, event, court hire or service.

• Bookings are not confirmed until required payment has been received and the booking has been confirmed.

• You are responsible for ensuring your booking details are accurate.

• Late arrival, non-attendance, leaving early or failing to use all or part of a booking may result in the booking being treated as used, with no refund, credit or rescheduling unless required by law or agreed by KPC.

• Cancellation or rescheduling requests must be made within the timeframe specified for the relevant booking.

• Packages, passes, credit bundles and prepaid sessions may have their own expiry dates, usage rules and cancellation conditions.

• If KPC cancels a paid booking and cannot reasonably provide a substitute booking, rescheduled session or credit, any refund or other remedy required under the Australian Consumer Law will be provided.

Refunds & Returns – Personal Use Items

Due to hygiene, health and safety considerations, KPC does not accept returns or exchanges or provide refunds for change-of-mind purchases of personal-use items, including but not limited to socks, orthotics, insoles, compression garments and similar products once purchased.

Please carefully review product information and sizing before completing your purchase.

Nothing in this policy limits any rights or remedies you may have under the Australian Consumer Law.

Safety, Risk & Liability

Participation in pickleball, coaching, court hire, social play, tournaments, programs, events and other activities involves inherent risks.

These risks may include slips, trips, falls, collisions, eye injuries, being struck by a ball or paddle, strains, sprains, fractures, aggravation of existing injuries, dehydration, fatigue, equipment failure, serious injury and other risks associated with physical activity.

You participate voluntarily, with knowledge of these risks, and are responsible for taking reasonable care for your own safety and for any child or minor in your care.

Our full Terms & Conditions contain important provisions regarding recreational activity risks, liability and your rights under the Australian Consumer Law and the Australian Consumer Law and Fair Trading Act 2012 (Vic).

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded.

Incidents & Injuries

Please notify KPC staff as soon as possible if you or someone in your care is involved in or becomes aware of:

• an accident or injury;

• illness or suspected concussion;

• a near miss or hazard;

• unsafe conduct;

• property damage; or

• another significant incident at the Venue.

Critical incidents must be reported immediately and KPC may require an incident report or supporting information to be completed.

By making a booking, purchasing a product or service, entering or remaining at the Venue, participating in any KPC activity or allowing a child or minor in your care to participate, you acknowledge and agree to the applicable Terms & Conditions.
